Compulsory Purchase
This is when the Government, local council or utility company has the legal right to buy or take rights over your private property if it falls within a public or private construction project.
In the case of a private residence it can also provide you with a legal right to acquire the freehold interest in your home from your landlord.
In some cases, the owners and occupiers of the properties to be acquired or affected by the scheme will be served notices, with differing expiry times. All schemes provide compensation to owners and occupiers directly affected by the scheme.
Lomax, Sons & Mills can advise both the claimant, and would-be purchaser of the above, on the assessment of compensation and the negotiation of individual claims.
In cases where agreement cannot be reached by negotiation, we have experience of appearing before the Leasehold Valuation Tribunal
On behalf of claimants we can advise on how best to protect their position if their land is included or adjacent to a potential Compulsory Purchase area. This can include submitting objections to the Compulsory Purchase Order and appearing at a public local inquiry. We can also advise on negotiation and settlement of compensation claims, including appearance before the Lands Tribunal if necessary.
